EXPERIENCE AS ARBITRATOR
Heard and decided cases involving issues of insurance law, wrongful death, personal injuries, property damage, business losses, construction disputes, real estate, commercial contracts, and employment law. Representative cases include:
A multi-party dispute involving claims of breach of a construction contract, failure to conform to specifications, defective work, and delay damages.
A multi-party dispute involving claims against a public employer alleging sexual harassment and hostile work environment.
Several cases involving claims of sexual harassment and other workplace and employment contract disputes.
Several cases involving claims for personal injuries and property damages by insureds against insurers under uninsured or underinsured motorist provisions of motor vehicle insurance policies.
Claims against the dramshop and the insurer of the decedents under the underinsured motorist coverage by three adult children of deceased parents who were killed by an intoxicated driver.
Multiple party claims for wrongful death damages by adult heirs of deceased insureds under underinsured motorist coverage.
An action for personal injuries, property damages and loss of business profits resulting from a motor vehicle collision and the adverse impacts on business operations of claimants.
An action against a tavern owner for personal injuries suffered by a patron when attacked upon the tavern premises by another patron.
An action for breach of contract and indemnification brought by a homeowners association management company against the homeowners association to recover litigation costs and fees, and the amount paid to settle the claim of a homeowner who was injured in a slip and fall on ice in a common area and sued the homeowners association and the management company for damages.
A dispute between insurance companies relating to the terms of a settlement agreement and the amounts each agreed to contribute to the settlement.
Claims against third parties for personal injuries resulting from motor vehicle collisions and from a skiing accident.
Claims by insureds against their own insurers for first party coverage to recover damages for injuries suffered in motor vehicle collisions, including claims for bad faith adjustment of their claims and punitive damages.

RELATED EXPERIENCE
Conducted numerous evidentiary hearings and written decisions as the administrative hearing officer for Nez Perce County, Idaho on matters of planning and zoning when serving as chairman of the Nez Perce County Planning and Zoning Board of Appeals.
Served as a neutral evaluator for parties who were entering into arbitration proceedings and requested an evaluation of the strengths and weaknesses of their case by a neutral lawyer with experience as an arbitrator.

ARBITRATION ADVOCACY EXPERIENCE
Representation of a mining company in a contract dispute with another mining company over the allocation of liability under the Clean Water Act and the Comprehensive Environmental Response, Compensation, and Liability Act for natural resource damages and costs of remediation of contamination of public and private lands used for mining since the turn of the century.
Representation of a school district in a dispute with an employee and the union over the interpretation of the master contract for teachers in the school district.
Representation of a publishing company in a dispute with an author over publication rights, the adequacy of promotional efforts and expenses, and the accuracy of accountings for royalties spanning several years.
